In this session, presented into the Property and Commercial Law Conference 2023, Mr David Shelley, Principal, Page Seager Lawyers and Mr Craig Pursell, Deputy Recorder of Titles, Land Titles Office, consider: Acquisition of easements by possession – serious hardship; Discharge or modification of overriding interests – evidentiary requirements; common issues; and, abandoned (s.108 LTA) vs obsolete (s.84C CLPA). The key takeaways from this session are: there is to be a new approach taken by the Recorder of Titles to the issue of serious hardship and a guideline is to be issued; the new Form is to be used for s.84C applications; and, consider using s.108 LTA before s.84C CLPA as the evidentiary requirement is easier to satisfy if it is applicable.

About the Presenter:

Mr David Shelley is the Managing Principal of Page Seager and has been with the firm for 25 years. He works with property owners and developers, managed funds and state-owned corporations, providing advice on infrastructure projects, property acquisitions and disposals, due diligence, property development, commercial leasing and large scale community housing projects. In addition, he regularly advises on duty and property related tax issues. David is also the Honorary Consul for France and for Germany in Tasmania. David regularly provides training and seminars to the Real Estate Institute of Tasmania and is a committee member of the Property Council of Australia (Tasmania Division).

Craig Pursell, Deputy Recorder of Titles, Land Titles Office (Tasmania)

About the Presenter:

Mr Craig Pursell graduated in 1995 with a Combined Arts/Law degree from the University of Tasmania. In January 1996 he commenced the legal practice course and in March 1996 commenced work as a graduate policy analyst with the State Government. Craig joined the Land Titles Office in 2002 and was appointed as Deputy Recorder of Titles in 2005.
