Mr Simon Gates presents into the Employment Law Conference 2021 on a topic that links workers compensation to employment law. In this session, Mr Gates reviews the applicable provisions of the Workers Rehabilitation and Conciliation Act 1988 and the leading cases involving their interpretation; gives consideration to the operation of the often-overlooked subsections 69(4)(b) and 69(4)(c) of the Act and the preconditions of their application; and Explores the possible implications of the injury management obligations imposed on employers, insurers and workers on the determination of weekly compensation payable to partially incapacitated workers pursuant to applications under section 88 of the Act.

About the Presenter:
Mr Simon Gates is a barrister and the current President of The Law Society of Tasmania. He was a member of Society’s Litigation Committee for the past five years. Prior to being a barrister, Simon was a partner at McLean, McKenzie & Topfer specialising in workers compensation, personal injuries and administrative law. Before entering private practice, Simon was Senior Legal Advisor to the Tasmanian State Attorney-General, and Crown Counsel in the Office of the Solicitor-General in Tasmania between 2007 and 2011, acting as Junior Counsel in a number of High Court Constitutional law cases.
