Costs – Avoiding Unwelcome Surprises

It should not be assumed that “the costs will come out of the estate”.  This session examines:

The range of costs orders that the Court may make

  • Successful applications

  • Altering the normal rules
  • Calderbank offers
  • Offers of compromise
  • Communicating clearly with clients as to the costs risk
  • Issues relating to the taxation of various costs orders

Timothy John Williams was admitted to practice of the 10th day of March 1981.  He spent his early career as a solicitor with the Public Trustee of Tasmania.  After a short interlude as a Crown Prosecutor he entered private practice in the early 90’s.  He was a partner at Gunson Williams until its closure on 30 June 2015 and is now running his own practice as a sole practitioner.  A significant part of his practice relates to disputes concerning wills and estates.  He has appeared as Counsel in numerous trials.
