Description
Mr Gregory Burton SC joined the Litigation Conference 2022 program to discuss the role of expert evidence;
expert evidence process – development, reports, conclave, concurrent evidence; the role of advocate and instructor in preparation and presentation of expert evidence; the potential pitfalls; and tips and preparation checklist. The key takeaways from this session are: expert evidence requires careful preparation and involvement of instructor and advocate from the outset – to set up assumptions, provide correct materials, ask the right questions;
concurrent expert evidence is frequently a useful mechanism, whatever the size of the case; and
be careful how you interact with the expert retained for your client – you can test their opinion but it must be the expert's opinion whether it changes or not.
