Description

This session is presented by Mr Tom Cox, Barrister at Malthouse Chambers into the Litigation Law Conference 2021. Mr Cox speaks on the following: a review of the evolving structure of the litigation profession in recent times with a particular focus on the junior litigator's place in that structure; a brief case summary of the Dunalley Bushfire Proceedings with a discourse on the key legal issues in the proceedings and the consequences that flow as a result of the resolution of those issues; and a brief look at the recent introduction of pre-judgement interest in this State. The key takeaways from the session are:

  • Reform is needed within the firms, at the bar and from junior litigators to arrest the expanding gap in experience and expertise of pre-trial and trial procedure between the senior and junior profession
  • The proportionate liability provisions in the CLA are not what they seem in the context of claims in nuisance at common law.
