The Northern Young Lawyers Committee invites to you to join Magistrate Evan Hughes for an enlightening, highly informative, and no doubt, entertaining session on ethics in the law. This session covers navigating and understanding the provisions of the ASCR is essential for all practitioners. In this presentation Magistrate Hughes explores some of the common, more complex and interesting ethical issues that arise including: confidentiality and imminent risk of harm; confidentiality and the probable commission of a serious offence; ethical and effective cross examination; are you conflicted?; and Lawyer X, some lessons learned.

Practitioners are given clear practical guidance on ethical problems that arise frequently and techniques for identifying and managing those issues. This includes the scenario of disclosure by a client of an intent to commit harm or an intent to commit a crime, and the comparison of the ASCR with other jurisdictions including internationally. The ethical and effective questioning of witnesses is a valuable skill and the balancing of effectiveness and ethics is a dynamic and delicate relationship. Some Q&A is provided around 'Are you conflicted?' and the Lawyer X story which has given us much more than just another mini series.

Magistrate Evan Hughes, Magistrate Court of Tasmania

About the Presenter:

Magistrate Evan Hughes joined the bench on 11 July 2022. Prior to this, Magistrate Hughes was a litigation lawyer and principal at Rae & Partners Lawyers. Magistrate Hughes practiced in both civil and criminal litigation. He has a background in criminal law from working with Tasmania Legal Aid for in excess of 10 years before expanding his practice into civil litigation with Rae & Partners. Magistrate Hughes was previously President of the Law Society of Tasmania, an executive member of the Council of the Law Society of Tasmania, and was Chair of the Society’s Litigation Committee from 2013 to 2022.
