Description

The Society welcomes back Alexandra Darcey, Barrister, Derwent and Tamar Chambers, who will share her extensive experience on the basics in quantification of damages in personal injury claims. In this session, Alex discusses:

  • Quantifications of damages
  • Antecedents
  • Heads of damage – general damages, medical expenses, economic loss and more

Key Takeaways

  • The antecedents that you rely on will set the parameters of your claim.
  • Care should be taken to ensure that the assumptions underpinning your quantum calculations are sound and will hold up to scrutiny. A consideration of the factual and the counter factual is required.
  • You need to appreciate the difference between, and be able to advise your client of, the purpose of particulars and how they might be calculated when compared with an advice on settlement range.

Testimonials from the Quantification of Damages Part I and Part II sessions run by Alexandra Darcey in 2018 and 2019, respectively.

  • This was a complex area presented in a clear and succinct manner, with great clear overheads.
  • Alex is a friendly and approachable/accessible speaker. The Q&A was excellent.
  • Alex came across as knowledgeable and easy to listen to – her planning was excellent as was her control of the room and the questions.
  • The material provided was well constructed and the delivery was considered and well articulated. Very enjoyable!
  • The presentation was clear, well-informed and excellent and added greatly to my knowledge of the subject.
  • Very enjoyable and great to have the cases printed out to go through separately. A great job!
