Mr Malcolm Schyvens, President, Tasmanian Civil and Administrative Tribunal (TASCAT) delivers this session on the role and functions of this state-wide, specialist Tribunal whose purpose is to provide a fair, independent, transparent and accessible Tribunal to all Tasmanians by meeting its statutory objectives contained under Section 10 of the Tasmanian Civil and Administrative Act 2020.

TASCAT, which commenced on 5 November, 2021, has the responsibility for resolving applications, appeals and other proceedings through appropriate dispute resolution processes such as mediations and conciliations, or through conducting hearings that provide a final decision about the proceedings. TASCAT has brought together 9 different Tribunals/Boards as part of the amalgamation. The amalgamated bodies were:

  • The Mental Health Tribunal
  • The Guardianship and Administration Board
  • The Workers Rehabilitation and Compensation Tribunal
  • The Asbestos Compensation Tribunal
  • The Motor Accident Compensation Tribunal
  • The Health Practitioners Tribunal
  • The Anti-Discrimination Tribunal
  • The Resource Management and Planning Appeal Tribunal
  • The Forest Practices Tribunal

The Tribunal is overseen by the President who is supported by Deputy Presidents, Senior and Ordinary Members, Registrars and staff.

Malcolm Schyvens, President, TASCAT

About the Presenter:

Mr Malcolm Schyvens was appointed as the inaugural President of TASCAT and commenced in this role in May 2021. Prior to commencing in this role, Mr Schyvens was Deputy President of the NSW Civil and Administrative Tribunal (NCAT), and Head of NCAT’s Guardianship Division. He has also held a variety of related roles in both NSW and Tasmania including President, (2011-2013) and Deputy President (2008-2011) of the former Guardianship Tribunal of NSW, Legal Member of Tasmania’s former Guardianship and Administration Board (2003-2008) and former Forensic Tribunal (2007-2008). Prior to this, he completed his university studies and commenced his career in legal practice in Tasmania at Dobson Mitchell and Allport. He was subsequently Managing Partner of Ogilvie Jennings. He is also a former President of the Law Society of Tasmania (2007-2008).

Up until his appointment as President of TASCAT, Mr Schyvens was Chair of the Australian Guardianship and Administration Council (AGAC), Conveynor of the NSW Chapter of the Council of Australasian Tribunals (COAT) and a Member of the Elder Law and Succession Committee of the Law Society of NSW. He is currently a Member of the Cultural Diversity Justice Network auspiced by the Judicial Council on Cultural Diversity.
