This session delivered by Chris Dockray and Phillip Zeeman as part of the Litigation Conference 2020 considers deciding who to call as a witness to your client’s case, and what (if anything) to ask witnesses for the opposing case in cross examination, is a critical strategic decision in most litigation that runs to trial. It is designed for experienced practitioners but of benefit for all levels experience. This session will provide insight from the perspectives of instructing solicitor and Counsel about the following:
- Dealing with witnesses under the new Rules of Practice
- Particular considerations when evidence is given by affidavit, including how to best address evidentiary objections
- When should subpoenas be used?
- Preparing witness statements – a how to guide
- What if a potential witness is unreliable, uncooperative, their evidence is a “bit of a mixed bag”, or a combination of those things?
- Are witness selection and cross examination decisions for the client, their lawyer, or their Counsel?
- Particular considerations when choosing expert witnesses
- How to decide whether or not to cross examine
- Analysis of the apparent effectiveness of witness choice and cross examination in Mercanti.
Christopher Dockray, Principal, CN Dockray
About the Presenter:
Mr Chris Dockray was admitted to practice in 1984. Mr Dockray is Principal of CN Dockray in Launceston. He graduated from the University of Tasmania in 1983 and worked with Zeeman Kable and Page for 11 years before setting up in private practice in 1995.
He has been a member of the Workers Compensation Tribunal, the Anti-Discrimination Tribunal and the Law Society Disciplinary Tribunal. Since 1989, he has been a Director of the St. Luke’s Medical and Hospital Benefits Association.
Phillip Zeeman, Barrister, Malthouse Chambers
About the Presenter:
Mr Phillip Zeeman is a barrister at Malthouse Chambers. He was admitted to practice in 1994 and signed the bar in 2013. Phillip qualified with a Bec LLB. He was partner at Murdoch Clarke and partner at Zeeman + Zeeman. Phillip is currently Vice President of the Tasmanian Bar Association, Member of the Local Government Code of Conduct Panel, Member of the Legal Disciplinary Tribunal and past Member of the Continuing Professional Development Committee Law Society of Tasmania.
