Undertaking A: Part-Time Practitioners

The below undertaking relates to the application of a reduced premium for part-time employees who meet the eligibility criteria below.

Part-time: For the purpose of the insurance scheme a part-time practitioner is a practitioner who is employed no more than 22.8 hours per week for the financial year 2023-2024 and will not work an average of more than 22.8 hours per week in the financial year 2023-2024.

On the advice of its underwriters, the Society is not able to provide premium refunds when a practitioner ceases to practice or changes employer during the course of the policy year.

The premium paid to underwriters includes unlimited run-off cover for “former practitioners” without the need for the payment of any additional premium in future years after the practitioner has ceased to practice.

IMPORTANT: The submission of your firm renewal application will constitute the giving of this undertaking if applicable.

Undertaking

I/We undertake:

  1. upon request to provide copies of formal contracts of service or other evidence to demonstrate that each part-time practitioner is employed no more than 22.8 hours per week for the financial year 2023-2024 and will not work an average of more than 22.8 hours per week in the financial year 2023-2024;
  2. to provide a declaration to the Society on behalf of the Law Practice by 31 July 2024 certifying that each part-time practitioner worked no more than 22.8 hours per week for the financial year 2023-2024 and did not work an average of more than 22.8 hours per week in the financial year 2023-2024. *Notes: This Declaration Form will be provided to all firms in July 2024;
  3. to notify the Society within 14 days of a part-time practitioner agreeing with the Law Practice to work for more than 22.8 hours per week;
  4. to pay any additional premium within 30 days of a written request unless otherwise agreed.
