The pre-eminent Ms Jacoba Brasch QC presents this session on the role of the ICL. She considers matters such as – having a position and being the honest broker; are you (ICL) value adding – changing, reviewing or terminating the appointment of the ICL; and what to expect from your ICL at trials and appeals.

This session also covers the following content:

  • it’s more than just getting expert reports
  • case planning and directing the traffic, but you are not the parties’ gopher
  • expertise and unconscious bias: family violence, cross-cultural matters

  • what does the evidence tell you – and don’t be afraid to say it (if a sound evidential basis)

Jacoba Brasch, Barrister

About the Presenter:

Ms Jacoba Brasch QC was admitted to the Bar in 2000 and practices in family law, mental health law, and customs and excise. She appeared in most States and Territories of Australia and often appears in the Full Court of the Family Court of Australia. Jacoba has also appeared a number of times in the High Court of Australia with those appearances concerning customs and excise, as well as Family Law matters and the Hague Convention (child abduction). Jacoba took Silk in 2014. Prior to coming to the Bar, Jacoba worked in law-related jobs, including Press Secretary to an Attorney-General. In 2000, Jacoba completed an LLM at New York University as a Fulbright Scholar and NYU Graduate Merit Scholar. In 2010, Jacoba graduated with a PhD from UNSW where thesis concerned what constitutes a fair, independent and impartial trial, using Australian courts martial as her subject matter.
